The Defense Calls Paul Huebner

Let's Get Ready For Some Testilying

WIS was just informed that the  Shomrim defense team will call Paul Huebner as a witness. After the testimony of  the five bochurim the defense would like to ask Paul some questions of their own.  Several witnesses testified that Huebner played a key role in the 749 blood libel. Just as WIS had predicted in previous articles of Huebners involvement in this case. One witness testified that Paul advised him for over two hours on the phone prior to testifying.  They all placed him at the hospital that night. Some could not remember if Paul filled out the reports for them or they filled them out (?). What is for sure is from what they testified it is very clear that Paul Huebner and the shmira mesira orchestrated and conducted this vicious mesira blood libel on the Shomrim 6.

WIS will inform the public as soon as we get any further detail on the exact date Huebner is to testify.
This is the day we are waiting for says a member of Shomrim. The day we the whole community will come to see and hear how this mesira came to play.

Jewish Patrol Assault Trial “Close to Farce”; Messiah to Be Called as Witness

The Flatbush Shomrim — a safety patrol of observant Jews — has been on fire lately. Last week they caught a graffiti artist and a car-breaker, and yesterday they took down a burglar. The Crown Heights Shomrim, meanwhile, has been much busier in court, with six of its members charged with beating up some students

after they responded to a yeshiva brawl on Eastern Parkway two years ago, allegedly over a dormitory bed.

The trial started yesterday and “veered close to farce,” says the Daily News, with heckling from spectators and “six defense lawyers objecting at once” as confusion ensued over the identity of the six bearded defendants. One attorney announced after the session, “I’m going to call the Messiah as my first witness”…

It has been suggested that the charges were instigated by a rival patrol called Shmira, which broke with the original squad years ago. A defense fund has been raised for the accused, and Rabbi Moshe Bogomilsky laments that “Torah rule dictates that Jewish people should bring their disputes, arguments and grievances against a fellow Jew to a Beis Din. Going to the civil court system is a heinous iniquity and a blatant contemptuous behavior against Torah.” Others claim that “the Bochurim received explicit permission to file charges from both Rabbi Shwei and Rabbi Osdoba respectively… and anyone who claims otherwise is simply spreading libelous slander.”

Rabbi Avrohom Osdoba released yesterday this letter in his defense, and that of the Shomrim Six. “Since it has been said in my name as if I heaven forbid gave permission to give over [Masser] and to inform [Malshin] on the members of Shomrim. I am here to clarify that this is a complete and total lie, and it is entirely not in my hands, since this sort of act is prohibited by Halacha in every way possible.”

It is clear and understood that it is permitted to call that police if he need immediate rescuing from a beating but immediately after one must call the parties to a Din Torah, and then it is upon the Beis Din to decide if it is permitted to continue with it.

And even further more in relation to a claim and prosecution that comes two years later, that this has no place to be discussed in the courts at all. As it is explained in the Shailos U’Teshuvos of the Ram”a Siman Pey Ches: “it seems that is isn’t relevant to this discussion, that specifically at that time during his anger it is understandable like is says in the Peskei Merizbur”g, but if he forgot his initial anger is plain and simple that it is not permitted.”

Furthermore, Messira is a horrible sin [lit. “criminal offense”] and is unthinkable [lit. “totally unacceptable”]. If they have any kind of claim, they must bring it before a Beis Din of Jews, and it is absolutely prohibited to indict them and to testify against them in a court of gentiles. As its is explained in the Shulchan Aruch Chosen Mishpat Siman Chof Vov Seiif Alef: “it is prohibited to deliberate before those who worship idols and in their courts…, even if the their law is a equivalent to Jewish law, even if both parties agreed to go before them on a claim, it is prohibited. And those who go before such a court, is an evil person, and it is as if he spites and scorns, curses and raises his hand to the torah of Moshe Rabainu of blessed memory. And it is in the hands of a Beis Din to judge him and excommunicate him [place him in Cherem] until he removes the idol worshipers from above his friends (Mahari”k Shoresh Kuf Nun Daled). And so would they excommunicate any who assists those who go before idol worshippers (Rivas”h Siman Kuf Beis).

This letter comes in direct contrast to that of these ‘alleged victims’ that has been circulating on certain agenda filled websites, and in Pashkvillen on the doorsteps of homes in Crown Heights, claim that they had the permission of Rabbonim to go to court, and that Rabbi Osdoba dismissed the Din Torah.

As we have reported these vicious individuals used the Hazmana to the Din Torah in court attempting to have the six defendants remanded and locked up for the duration of this long, tedious and expensive trial. And these are the same people that so callously twisted and used the names of Rabbonim to further their own agenda, with blatant disregard for the respect of the Rabbonim of this community.

In America and in all democratic country you are innocent until proved guilty.

For over two years this case has been dragged out. we read and heard a lot of things. One website writes for Shomrim while the other writes against, were does the truth lie?

The jury has been picked and the case is on for trial. Several witnesses took the stand and swore under oath to tell the truth, the whole truth and nothing but the truth. The now famous video has been played over and over in court. Now it’s up to both the prosecution and the defense to prove their guilt or innocent.

What did happen in 749 that night? Who orchestrated it? Who is responsible? And who should be held responsible?

For over 10 years Yossi Stern and Yanky Prager have been trying to bring down Shomrim. Through the years they Masered on countless members of Shomrim.  Members of Shomrim were arrested several times by Stern and his gang on false charges. Their homes and businesses were subjected to Mesira.

From the moment Stern heard about the fight at 749 he put his gang to play. He immediately sent Leib Skoblo to 749. Once they arrived they started screaming at the police to arrest the Shomrim members. Skoblo even showed his auxiliary badge to help convince the police. When Skoblo was unsuccessful he then called for back up.

Soon after Yossi Stern ,Yanky Prager and Levi Huebner showed up to 749. Stern with a pen a pad handy immediately started to take names of Bochurim that were willing to press charges  on Shomrim. Once he had his list he got to work. Members of shmira worked endlessly all night, transporting Bochurim from 749 to Kings County Hospital and then to the 77th pct. at the hospital and the 77pct they carefully guided the Bochurim in what to say in order to have Shomrim arrested. Levi Huebner even acting as a translator for the police.

Over the past two years several community members tried to get shmira to  stop the fight against Shomrim and to have the charges dropped . Yossi Stern over and over denied that he nor any  member  of shmira had anything to do with the 749 arrests.

WIS has obtained several police reports showing Stern and his gangs mesira on Shomrim. Over the course of the trial Stern and his gang are working tirelessly to spread their propaganda and hate toward Shomrim. Trying to finish what they started they sent out mass propaganda emails with their side of the story. Mass email were sent out telling people not to donate to the Pidyun Shvoyim fund. When the community Rabbonim got involved, they used it against the Shomrim Six in court, trying to hold them for tampering with the witnesses. Menachem Kozlovsky a shmira member was seen bringing the witnesses to court to testify.

Now its up to you the community to bring justice to this case. You the community have a responsibility to stop this mesira, to tell this hate group called shmira we don’t support messira. to tell these mosrim to find another Shul to Daven in. You must stop justifying mesira by saying “they said you did this or that” because when the jury comes back with a not guilty plea you will be responsible for the blood that was spilled.

When did the DA office in NY EVER attempt to prosecute anyone for this kind of a brawl? My guess – never!

After seeing this ridiculous video today, the only reason I can come up with to explain the DA’s decision (and enthusiasm) to prosecute is this:
They hate the Jewish private patrol groups, but never had a chance to prosecute them because no one ever testified from the inside before this. So here, all of a sudden, they have Jews willing to testify, and they went for it!

This nothing less than an attempt by the DA to muscle Shomrim-type patrols out of existence! This is also the reason they offered deals to everyone but one – it is enough for them to get one person to scare everyone else involved in this type of patrol activity!

I opened the court room door quietly almost afraid to be seen, to my present surprize it was full of lubavichers who had come to support shomrim. honestly i didnt go for that i went for the video i heard was going to be played.

see over the past 2 years and more often now i  have seen on many of the hate sites that there is this “Video” that proves the aggression and hate that shomrim have to the tzfatim and proves that they went into 749 with the intent to hurt the bocherim.

now if only i could show you this video.. its something that you must see for yourself (it may be show again and again in court its worth going to watch) it doesnt show not one of the allegations is shows only the opposite, its shows shomrim getting pushed and pulled and glasses being torn off their faces.

AFTER SEVERAL CROWN HEIGHTS RABONIM TOOK THE INITIATIVE TO CALL ALL PARTIES TO A DIN TORAH LEVY HUEBNER TURNS THE GUN AT THE BAIS DIN.

THE DIN TORAH WAS TO TAKE PLACE ON SUNDAY AT 9:00.  HUEBNER SHOWED UP AT 9:30 WITH THE 749 BOYS AND TOOK SOME PHOTO IN FRONT OF THE BAIS DIN OFFICE. AFTER ABOUT 15 MINUTES HE LEFT. RABBI SEGAL THEN CALLED HIM EXPRESSING CONCERN AS TO WHY HE DID NOT SHOW UP. HUEBNER TOLD HIM THAT HE WILL BE BACK AT 10:30. SUSPICIOUS OF HUEBNER THE MEMBERS OF SHOMRIM OPTED NOT TO SHOW WITHOUT THEIR ATTORNEYS PERMISSION.

HUEBNER AND HIS BOYS SHOWED UP AND DEMANDED SEVERAL THINGS FROM THE RABBI SEGAL. SEGAL INFORMED HIM ABOUT THE HALACHA AND ASSURED HIM HE WILL FOLLOW THRU WITH THE SHOMRIM 6.

HUEBNER HOWEVER HAD OTHER INTENTIONS. MONDAY MORNING THE DISTRICT ATTORNEY IN CHARGE OPENED THE COURT HEARING WITH A CHARGE THAT THE CROWN HEIGHTS BAIS DIN WAS IN CONTEMPT OF COURT WITH REGARD TO WITTINESS TAMPERING AND HE WILL FOLLOW THRU WITH A WARRANT.

Beat-trial defense blames Orthodox rivals

A long-standing rivalry between two Orthodox Jewish neighborhood patrols took center stage yesterday in the trial of a half-dozen men accused of assaulting yeshiva students in Crown Heights two years ago.

Six members of the Shomrim patrol are charged with attacking the four students after having been called to break up a melee at the school.

But one of the defense lawyers said in her opening statement that the defendants were charged as a result of efforts by Levi Huebner, a lawyer for a rival patrol called Shmira.

Attorney Joyce David said Huebner called police the day after the violence and offered to translate for the Hebrew-speaking students.

But he neglected to disclose that he represented Shmira, she said, and he later pressured detectives to arrest the Shomrim squad.

The two patrols’ history of bad blood dates back to the late 1990s, when Shmira splintered from the original group.

“[Huebner] orchestrated this case. He played the DA’s office; he played the police,” said David, who represents defendant Chaim Hershkop, 28.

She added that Huebner filed a $140 million lawsuit against Shomrim on behalf of the students.

After yesterday’s session, Huebner said, “I believe that the only place the case should be tried is in the court.”

Prosecutor David Weiss, meanwhile, called Shomrim a “gang” whose intention that night was to attack helpless yeshiva students and “beat them indiscriminately.”

But defense lawyer Tedd Blecher argued that the defendants were “like Boy Scouts” up against a hostile bunch.

“They’re not yeshiva boys; they’re full-grown adults, many of whom are much bigger than the defendants,” said Blecher, who represents Benjamin Lifschitz, 23

The defendants, most of them in their 20s, could face up to 15 years in prison if found guilty.

Yeshiva row over Messiah goes to court

What began as a brawl in a Brooklyn yeshiva dorm over a revered rabbi has left six members of a Jewish patrol group facing gang assault charges in a state Supreme Court trial that started Monday.

The fight – over whether the late Rabbi Menachem Schneerson is an emissary of God – also led to broken bones, a $150 million lawsuit and a battle between two rival patrol groups.

“I’m going to call the Messiah as my first witness,” defense lawyer Tedd Blecher quipped after the trial’s first day.

With six defense lawyers objecting at once, a kibitzing crowd and the first witness having trouble telling six bearded defendants apart, the trial veered close to farce.

The defendants, members of the Shomrim watch group, face 15 years – and prosecutors were serious when they told Brooklyn Supreme Court Justice Albert Tomei of possible witness tampering just before opening statements. The six defendants were called to a Yeshiva dorm on Eastern Parkway to break up a fight between four members of the Messianic group and others on Dec. 29, 2007.

“It seems that the defendants had one goal and that was not to mediate,” Assistant District Attorney David Weiss told jurors. “It was to beat up a bunch of yeshiva students.”

Defense lawyers said the case was instigated by an attorney affiliated with Shomrim’s rival guard group who also filed the lawsuit.

WE MUST NOT FORGET

Regardless of the outcome of the trial we must not forget what got Shomrim there.

Since Shmira came to power in 1996 after Dovid rogatsky was thrown out of Shomrim there goal was to destroy Shomrim. Several times they had Shomrim members locked up and or accused them of crimes that never happened.

When Shmira heard that Shomrim was handling a dispute at 749 they immediately took action. Leib Skoblo the first to arrive. Immediately instigating the police to lock up members of Shomrim. A few minutes later Yossi Stern together with Yanky Prager showed up. All night they together with Paul Levi huebner, a Shmira attorney worked tirelessly to build a case against Shomrim.

When does it start and when does it finish? They, Shmira have been starting with Shomrim ever since they exist. Shomrim has always maintained a professional etiquette when it came to Shmira. Always ignoring them as if they didn’t exist. That got them mad, all the way to the point of this, the mesira that occurred at 749 Eastern Parkway.

Yes, Shmira instigated, orchestrated and led this full blown Messira against Shomrim. You will hear them say things like “it is there fault they are in trial because we offered them a plea and they refused it” or better yet ” they refuse to sit down with us” or even the best one I have heard so far “they made a web site disclosing all the criminal activity we do.”

Leib Skoblo, what are you going to tell your kids when they ask you why did you Masser on another Jew? You didn’t think it would get this far. But it did, and you are responsible. Or did you do it for the PBA card or the COP ID card?

Remove the web site and we will remove the charges, says Paul Levi ‘the terrible’ Huebner who is an attorney for Shmira.

In the past two years WIS disclosed several pieces of evidence that prove that Shmira and its members massered on Shomrim and its members. Shmira on the other hand claim that Shomrim masered on them. Yet, up to date I have not seen one piece of evidence proving so. Shmira now has all the connection they need with NYPD and other Government Offices. Don’t you think it would be easy for them to retrieve evidence to prove there case? The truth lay in the evidence not in there propaganda.

This web site is, was and will always be here to disclose anyone from Shmira. No matter how many emails or comment you send in begging or threatening me to close it down. There is however one way it will close, that is if Shmira closes.

This game has just begun and you have not seen anything yet!!!
