One Year Ago Today: Shomrim Six Vindicated from the Messirah and Blood Libel

It was last year on this day, the 22nd of Kislev, just a day after the Alter Rebbe celebrated his Didan Notzach, that the Shomrim Six were vindicated from the vicious blood libel and Messirah against them.

Shomrim did not celebrate the verdict as a victory, but as a salvation. The motto of cases conclusion rested in the song which is sung at Yud Tes Kislev Farbrengens around the world, “Podo Beshalom Nafshi… Anshei Domim Umirma Lo Yechtzu Yemaihem” ([g-d] has redeemed my soul in peace… men of blood and swindle may their days be halved).

The trial, before the Hon. Judge Albert Tomei, dragged out a grueling 6 weeks in the same courtroom in which murder and mob trials took place. There the six defendants sat behind their team of six defense attorneys, and watched the mockery of the New York State courts unfold, as witness after witness stuttered and stumbled over each other’s words and stories, through the aid of a translator.

Meticulously, the defense picked apart the prosecution’s case and witnesses, to the point where the judge tossed out the majority of the charges even before allowing the jury to deliberate the case.

Out of the six lawyers hired four of them were legal aid assigned council and the two others were hired and paid for. Between the two of them the costs of the trial exceeded $200,000. The Shomrim emergency defense fund raised close to $25,000 in donations from supporters.

Currently the criminal proceeding has concluded, but the matter of the $149 million civil suit against the Shomrim six, filed by Paul Huebner the attorney for Shmira, is still being actively pursued.

Shomrim has maintained their innocence throughout the two years leading up to the trial and the trial itself, the verdict proved that. Shomrim also alleged that there are bigger matters at play, beginning with political pressure to embellish the charges, and the fact that the DA did not fly the witnesses in, yet they were flown in and their transportation to court was all arranged.

Despite all these Shomrim volunteers remained active and continued doing their work, helping and protecting the community with the support of Shomrims’ loyal supporters.

Tonight the Shomrim Six will get together for a Farbregnen in which they celebrate their victory and triumph.

22nd Day Of Kislev 5770 – December 09, 2009

BROOKLYN, NY [CHI] — Today the six Shomrim members who stood trial for what has been dubbed “a modern day blood libel” have been vindicated. All of the major charges against them were either dropped or found not guilty by a unanimous verdict.

Last week, when the prosecution rested and concluded their case, the judge dismissed all charges relating to the allegations about weapons being used at the incident. The gang assault charges were also dismissed by default, for failure to present enough evidence.

The one charge was found guilty against one of the Shomrim volunteers. It was for assault in the 3rd degree, baffling all who were present in the courtroom, including the co-defendants and lawyers.

Upon exiting, the jurors were polled as to the reasons behind their findings; majority answered that none of the witnesses sounded like they had been telling the truth.

Defense council said it was clear that any attack by Shomrim was out of self-defense and that an appeal is forthcoming.

“This is not a Didan Notzach and Shomrim is not celebrating this verdict,” said a spokesperson for the defendants, adding, “We are devastated that our fellow volunteer and friend has been found guilty of this Messira and blood libel. Let us not forget that we still have the $150 million lawsuit against us.”

On a more positive note, Shomrim said, “We were here yesterday, we are here today, and we will be here tomorrow for anyone who calls on us for assistance.”

AFTER 2 YEARS AND 22 DAYS OF TRIAL ALL 6 SHOMRIM MEMBER CLEARED OF THEIR CHARGES. ALTHOUGH IT IS A “VICTORY” AND SHOMRIM WON THE BATTLE THE WAR IS YET TO BE FOUGHT. THERE IS STILL THE 144 MILLION DOLLAR LAWSUIT THAT WAS BROUGHT ON BY PAUL HUEBNER.

THERE IS STILL THE DAY TO DAY MESIRA THAT IS BROUGHT AGAINST SHOMRIM MEMBERS IN THEIR BUSINESS AND HOMES ALMOST DAILY.

LET’S NOT LOOSE FOCUS ON WHO IS RESPONSIBLE FOR THIS BLOOD LIBEL. AS TIME GOES BY MORE AND MORE OF THE PIECES ARE BEING PICKED UP, EVENTUALLY THE PUZZLE WILL BE COMPLETE. RECENTLY  WIS  REPORTED TO YOU HOW IT WAS  HENNA WHITE WHICH PUSHED (WITH UNPRECEDENTED PRESSURE) THAT THE SHOMRIM SIX BE FULLY PROSECUTED IN THE COURT OF LAW.  CHANINA SPERLIN GOT MRS. WHITE HER JOB AT THE DISTRICTS ATTORNEYS OFFICE.

EXCLUSIVE: Possible Lawsuit Against Rebbi Rosenberg

In the last week WIS has received numerous emails calling our attention to possible legal action against the Zabla Bais Din. All this as Rabbi Rosenberg has to come to a final decision over Braun candidacy, and Braun promoters want to bring Braun in for Yud Tes Kislav to CROWN him Rov, regardless if he has Smicha or not. The emails allude to the fact that the Zabla Beth Din, primarily Rabbi Avraham Rosenberg, have violated his own verdict – Psak Din.

“What was the point of the Psak if  in the end nothing in it really matters?” asked one resident. He continued “Your trying to rebuild a Bais Din that the community should take seriously, while the whole Psak on which its based is one big joke” is this the way things are done “My 13 year old son has the same eligibility” he added. “He’s under 40, No Smicha, and even knows how to use a Blackbarry” he concluded.

So can there really be legal action?

The arguments being made is that after so much time and money was wasted on a Din Torah, the community was let down.

Crime of Silence: Passivity Vs. Political Correctness

“In this very real world, good doesn’t drive out evil. Evil doesn’t drive out good. But the energetic displaces the passive (William Bernbach).”

Having become increasingly committed to Torah Judaism, a woman once lamented in bemusement: “Rabbi, will my moral conflicts ever end? I had hoped, in embracing Judaism, to no longer struggle with issues of moral substance.” After all, is that not what Judaism is about? Yet, it had not turned out that way in the least,” she proceeded in exasperation, “To the contrary; my struggles have become considerably amplified.”

Was the woman right? Do our struggles with right and wrong ever end? Does it ever become obvious how do deal with aggression? Is the fine line between justice and revenge ever clearly defined? Will we ever be certain when to be passive and when to react, and how forceful a reaction is appropriate?

Will we ever know, with unequivocal certainty, when to protest and when to bite our tongues; when to bestow love and when to apply discipline? If these issues have dogged man in the past, the challenge is that much more intensified in our age of political correctness.

While the origins of political correctness is rooted in noble intentions, like so many other good ideas, its benefit was short lived.

Political correctness has been quickly pushed to a counterproductive extreme; whose purpose is to avoid offending anyone. Offending someone has become the ultimate evil to be avoided at all cost. The result of this new creed is not more civil debate, but rather no debate at all. The latter is robbing society of fundamental freedoms.

False 311 Complaints Leave Homeowners Fuming

The Queens district attorney’s office is looking into claims that someone is filing numerous false complaints against property owners in the borough through 311. NY1’s Ruschell Boone filed the following report.

Calling a complaint that there is an illegal first floor conversion in her home on 28th Avenue “completely fictitious,” a Queens homeowner — who did not want to be identified — says she found out about the complaint a few days ago after neighbors said last year someone phoned in similar complaints about their property to 311.

“We found out that back in October hundreds of homes were given complaint notifications and now the buildings department is coming around,” said the homeowner.

Three blocks away on 25th Avenue, homeowner Billy Colangelo said DOB inspectors have been to his house twice.

“I bought the house a little over five years ago and we didn’t change anything. So if everything was legal then I don’t know what happened to make it illegal now,” Colangelo said.

Many of Colangelo’s neighbors say they too have received complaints about problems they don’t believe exist.

“Some of the homes cited for having an illegal conversion of the basements didn’t even have a basement. Some of the building locations, we pulled them up with block and lot numbers, where the buildings had been demolished and there were no longer homes on the properties being listed,” said City Councilman Dan Halloran.

Halloran and dozens of residents in Flushing, Whitestone and Malba say they believe two construction companies are calling the complaints in as a way to drum up business.

“They were coming around handing out construction cards to the people that got the violations to get the contract.

NY1 reached out to both companies for comment. One said residents had no proof and denied making the calls. The other said it was aware of the claims, but it too denied the allegations.

The Queens district attorney’s office says it’s looking into the matter. The New York City Department of Investigation says it too is aware of the issue but had no other comment.

While the complaints are being looked at, homeowners say they want the Department of Buildings to halt inspections of their homes until the matter is resolved. But the agency says complaints like these have to be investigated to ensure public safety.

Residents, meanwhile, say they just want the city to get to the bottom of the issue.

EXCLUSIVE UPDATE: Yitzchok Shuchat

A Brooklyn man wanted in the beating of a cop’s son is hiding in plain sight in Israel – enraging the victim’s dad.

Yitzhak Shuchat, 27, fled after the incident and is living outside Tel Aviv with his wife and children, his family confirmed Monday.

“It’s a disgrace,” said NYPD cop Moses Charles. “My son is still suffering, and this guy gets to enjoy his life.”

Andrew Charles, then 20, was riding his bike through Crown Heights in April 2008 when he was set upon by a gang of men who doused him with pepper spray and beat him with a night stick.

Shuchat – a member of a Hasidic civilian crime patrol named Shmira – was identified as one of the attackers in the racially charged incident.

An arrest warrant was issued in May 2008, although the charges have not been made public.

Shuchat fled to Montreal and then Israel shortly afterward, investigators believe.

His secret was not made public until this year, when a man entirely unconnected to the case hunted the fugitive down and turned over the information to the Brooklyn district attorney’s office.

Brooklyn car mechanic Aron Hershkop – a member of a rival crime patrol group, Shomrim – became convinced last year that Shuchat was harassing him from overseas.

Hershkop said his complaints to authorities fell on deaf ears.

So he hired a private investigator, Joe Levin, who easily located Shuchat in Lod, where Israel’s largest airport is based.

“If I was able to find him with my resources, why can’t the government find him with their resources?” Hershkop said.

He said he told Brooklyn prosecutors last month where they could find Shuchat.

A spokesman for the district attorney would not say how long the office has known where Shuchat is hiding out.

“We have been actively pursuing his extradition, and we will continue to do so,” District Attorney Charles Hynes said.

The office referred further questions to the State Department, which referred questions to the Justice Department. The Justice Department declined to comment.

Charles said he was never told investigators knew where to find one of his son’s accused attackers – nor was he given an explanation for the holdup.

“I wasn’t aware of this. I wasn’t given any information,” the 42-year-old officer said.

Shuchat did not respond to a message left with his mother-in-law, Rachel Kirschenbaum.

Messiah called as first witness

What began as a brawl in a Brooklyn yeshiva dorm over a revered rabbi has left six members of a Jewish patrol group facing gang assault charges in a state Supreme Court trial that started Monday.

The fight – over whether the late Rabbi Menachem Schneerson is an emissary of God – also led to broken bones, a $150 million lawsuit and a battle between two rival patrol groups.

“I’m going to call the Messiah as my first witness,” defense lawyer Tedd Blecher quipped after the trial’s first day.

With six defense lawyers objecting at once, a kibitzing crowd and the first witness having trouble telling six bearded defendants apart, the trial veered close to farce.

The defendants, members of the Shomrim watch group, face 15 years – and prosecutors were serious when they told Brooklyn Supreme Court Justice Albert Tomei of possible witness tampering just before opening statements. The six defendants were called to a Yeshiva dorm on Eastern Parkway to break up a fight between four members of the Messianic group and others on Dec. 29, 2007.

“It seems that the defendants had one goal and that was not to mediate,” Assistant District Attorney David Weiss told jurors. “It was to beat up a bunch of yeshiva students.”

Defense lawyers said the case was instigated by an attorney affiliated with Shomrim’s rival guard group who also filed the lawsuit.

UPDATE: The Messiah did actually come to court to testify that day, he said that as a result of what he was witnessing in the court room he must leave and not reveal himself . The Messiah went on to say, if so called Jews can testify and prosecute  innocent Jews and a whole community sits in silence and let’s it happen, then they are not deserving of his revelation.

In his closing remarks the Messiah said, not all hope is lost, looking around I do see a packed court room of many good caring individuals, with acts of goodness, kindness and getting ride of the scum/mossrim there is still hope.

We know for a fact that this was the real Messiah, for the Messiah of Chabad.info was wrong and this Messiah was right when he said, “if so called Jews can testify and prosecute  innocent Jews“.

Crowning a Nobody: Braun a Danger To Crown Heights

They say if you want to know who a person is just look at who his friends are.

Braun claims not to know who campaigned for him. I believe that’s a lie. The same people who campaigned for him were the ones that paid his ticket to the states.

For arguments sake we will say that Braun didn’t know. So now we will take the liberty of telling him. Judging from those who “celebrated” his win we know exactly what Crown Heights is getting. The people who brought Braun to Crown Heights are Mossrim, Ganovim and hate mongers, what does that make Braun?

Brooklyn South Police Chief Joseph Fox, in command of the 70th Pct. was called.

Fox said he’ll take steps to correct the problem and the officers will be disciplined, as they are from the Boro Park and Flatbush area and should be aware of Hatzalah’s activities.

The Jew Doesn’t:

But the head of the Crown Heights Hatzalah Yingy Bistritzky says that false reports of the incident were spread by individuals looking to discredit police work.

In response to rumors about the police lack of understanding, Bistritzky says you can’t ‘have your cake and eat it too.’

“The police were actually there for a security watch in response to the recent terror threat on shuls, and we should be thankful for that.”

What did the actual Hatzalah member who this happened to have to say. He obviously contacted the other web site [Ch.Info] to tell them the story, how else would they know.

If it was no big deal, why would that member feel he had to tell someone or anyone, unless he felt the way it was depicted on the other web site [CH.Info].

I think its disgusting what Yingy is doing here. He is putting the police before the community and putting his members and community in danger.

Mishichistim Mossrim Have Nowhere To Go But Backwards

The Mishichistim Mossrim can’t move forward so they are attempting to move backwards (going back in time to old and frankly stupid arguments which have all been proven wrong).  WIS is not going to get in to the mud with them (true or not true etc…), these issues were dealt with over 10 years ago and frankly is a big waste of time.

However, WIS is  going to throw more mud at them.

Who is the face behind the Mishichist Mossrim Party making these claims? How come there is no face, why is he or they hiding behind a web-site which doesn’t either have a face behind it? And if there is no face, is there really a need to respond, after all to whom are we responding to and why do we even have to respond to them, who are they that we have to respond to them?

    1. Sholom Bruchstat said he only brought 320 chairs for the mishichist Kimzitz (what they call the Kinus).

    2. Many places were empty. 100 chairs were not even unfolded.

    3. More then half were Crown heights residents.

    4. Many mossrim were there as-well, thats expected after all it is a meeting of mishichist mossrim. Mendle Hendel the mosser. Chanina Sperlin the mosser. Yankle Spritzer the Mosser. Joseph Speilman the mosser. Shuki Gur the Mosser etc…etc… Everybody sitting there would justify mesira one way of the other.

    5. All those sitting there (don’t take my word for it, check out their pictures), are sitting like they have to take a really nasty dump like they have diaria , it’s as if they have something either up there ass or something is coming out.

How Many of These 311 Calls Were Made in Crown Heights to Masser On a Neighbor?

New Yorkers are accustomed to strong odors, but several years ago a new aroma began wafting through the city’s streets, a smell that was more unnerving than the usual offenders (trash, sweat, urine) precisely because it was so delightful: the sweet, unmistakable scent of maple syrup. It was a fickle miasma, though, draping itself over Morningside Heights one afternoon, disappearing for weeks, reemerging in Chelsea for a few passing hours before vanishing again. Fearing a chemical warfare attack, perhaps from the Aunt Jemima wing of al Qaeda, hundreds of New Yorkers reported the smell to authorities. The New York Times first wrote about it in October 2005; local blogs covered each outbreak, augmented by firsthand reports in their comment threads.

The city quickly determined that the odor was harmless, but the mystery of its origin persisted for four years. During maple syrup events, as they came to be called, operators at the city’s popular NYC311 call center—set up to field complaints and provide information on school closings and the like—were instructed to reassure callers that they could go about their business as usual.
